I don't think throwing a copyright notice on top of copyrighted material excuses you from using someone else's copyrighted materials. If you retyped a Harry Potter book and posted it on your blog with a "©J.K. Rowling" notice, she or her publisher would sue you for copyright infringement. This looks like dangerous waters.

while your concern is noted, i think it is largely misplaced.
puzzle constructors and others stop by with some regularity and no one has has raised any red flags. quite the contrary, many folks are quite positive with regard to the imaginative and thoughtful family-oriented presentation.
the whole purpose of this blog is to educate and perhaps entertain through sharing information. i offer nothing else. i neither demean, defame nor endorse any persons, products or practices.
this is a labor of love. i make no money from my endeavors.
if, in the course if this, people are exposed to something that they can further investigate and make use of to lighten and/or better their lives, so be it.

In particular, the "exclusive rights" and "fair use" sections. The NY Times holds exclusive rights. In a fair use analysis, four factors are considered.
1. the purpose and character of your use
2. the nature of the copyrighted work
3. what amount and proportion of the whole work was taken, and
4. the effect of the use upon the potential market for or value of the copyrighted work.
#3 = every single clue that goes into a crossword
#4 = all someone has to do is make their own answer grid, and they have the entire crossword puzzle without having to buy the newspaper, subscribe to the NY Times' puzzle service, or buy a book compilation. Anyone with Web access can find the clues on your blog.
Really I think you place yourself at risk of a lawsuit for copyright infringement. Do you have the resources a major media company has? I would not want to go up against them.

It would be interesting to know what material is objectional -- perhaps then a dialogue could ensue -- I just hope it wasn't Val's photograph or the lightning striking the Eiffel Tower, terrific stuff that will bring the dead page to life any day!
If I'm driving down the road and take a photograph that happens to include a few commercial establishments and then print and publish on the internet, is that a problem? The internet itself is a road, and if it's out there, it's out there, and anyone can see it!
